Date Filed Document Text
November 29, 2022 Opinion or Order Filing 9 ORDER: The Court has become aware that the Plaintiff is no longer housed at the Garner Correctional Institution as the Plaintiffs Notice of Change of Address #8 indicates he is now housed at the Corrigan Correctional Center. Therefore, it is not clear whether the Plaintiff received the Courts notice of insufficiency dated November 1, 2022. Accordingly, the clerk is instructed to send a copy of the Notice of Insufficiency [ECF No. 7] to the Plaintiff at the Corrigan Correctional Center. Failure to comply with the Notice of Insufficiency or this Order by December 13, 2022 may result in the dismissal of this action. The clerk is also instructed to update the Plaintiffs address on the CM/ECF system accordingly. Signed by Judge Thomas O. Farrish on 11/29/2022.(Corriette, M.)
November 3, 2022 Filing 8 NOTICE of Change of Address by Jose Anthony Torrez (Corriette, M.)
November 1, 2022 Filing 7 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. As the court previously explained, he may do so only if (among other things) he files a certified copy of his inmate trust account statement for the six month period preceding his complaint. The plaintiff has now filed a trust account statement, but it has not been certified by an inmate trust fund officer or prison counselor, as required by 28 U.S.C. 1915. The plaintiff will be given one more opportunity to fix this insufficiency. He is directed to file with the Clerk of the Court a certified copy of his inmate trust account statement covering at least the period from April 3, 2022 to October 3, 2022. If he does not do so by November 21, 2022, his case may be dismissed. Signed by Judge Thomas O. Farrish on 11/1/2022.(Corriette, M.)
October 13, 2022 Filing 6 Prisoner Trust Fund Account Statement by Jose Anthony Torrez. (Attachments: #1 Cover Sheet)(Sichanh, Christina)
October 7, 2022 Filing 5 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if, among other things, he files a certified copy of his inmate trust account statement for the six month period preceding his complaint. In this case, the plaintiff did not do so. The plaintiff is therefore directed to file with the Clerk of the Court a certified copy of his inmate trust account statement covering at least the period from April 3, 2022 to October 3, 2022. If he does not do so by October 28, 2022, his case may be dismissed. Signed by Judge Thomas O. Farrish on 10/7/2022.(Corriette, M.)
