Filing 30 ORDER re: Settlement Conference. Judge Farrish will hold a settlement conference in this case on January 9, 2023 at 9:00 a.m. and, if that conference does not result in a resolution, a second conference on January 19, 2023 at 9:00 a.m. Both conferences will begin in the East Courtroom of the Hartford courthouse. Persons having authority to decide all issues that can reasonably be expected to arise are required to attend in person, and any party who breaches this requirement may be subject to sanctions.In preparation for the conference(s), the parties are ordered to do the following:* By close of business on December 20, 2022, plaintiffs' counsel shall send to defendant's counsel a carefully prepared list of the minimum information the plaintiffs feel they need from the defendant in order to have a productive settlement conference. If the defendant feels that the list is overbroad or unduly burdensome, or if it believes there is another reason why the information should not be provided at this time, the parties are directed to meet and confer in good faith in an effort to resolve the dispute. If they are unable to do so, they may request Judge Farrish's intervention by calling his law clerk at 860-240-3605 with opposing counsel on the line.* Plaintiffs' counsel shall transmit an initial settlement proposal to defendant's counsel by close of business on December 23, 2022.* Each party shall prepare two versions of a mediation statement, one to be provided to its opponent and one to be provided ex parte to Judge Farrish, by 5:00 p.m. on January 4, 2023. The version to be shared with the opponent shall include (a) the partys statement of the material facts; (b) the partys view of the applicable legal principles and how they apply to the case; and (c) the partys most recent settlement proposal. The version to be submitted ex parte to Judge Farrish shall include all of the foregoing, plus a candid statement of which elements of the settlement proposal the party is or is not willing to be flexible on; and if there are elements on which the party is unwilling to be flexible, a detailed explanation why. The ex parte version is limited to twenty pages exclusive of exhibits; if a party feels that exhibits are necessary to Judge Farrish's understanding of the case, it may attach a reasonable number. Because the parties will likely be ordered to attend the conference, either in-person or via videoconference, counsel are instructed to obtain their client's schedules over the next ninety days and have them available during the pre-conference.
