ORDER TO SHOW CAUSE. Under 28 U.S.C. section 1915(e), courts are required to dismiss any action that is frivolous or that fails to state a claim upon which relief can be granted. The complaint purports to proceed under 42 U.S.C. sections 1983 and 1985, but the factual allegations do not align with either statute. Rather, Plaintiff seems to allege that the defendants have unlawfully disposed of some of Plaintiff's personal property in connection with the foreclosure of real property. The court cannot discern a cognizable claim in the allegations. Moreover, it is not clear that, even if there is a cognizable claim, federal jurisdiction is proper. Therefore, Plaintiff is instructed to show cause on or before February 28, 2023, why this case should not be dismissed. Failure to comply with this order will result in dismissal of the action. Given the court's concerns regarding subject matter jurisdiction, all deadlines in this matter hereby are stayed pending further instruction from the court. Consequently, the motion for extension of time filed by Defendants Guardian Asset Management and Jerry Mavellia, see ECF No. #9 , is denied as moot. Signed by Judge Omar A. Williams on 1/26/23.
