June 27, 2022 Opinion or Order Filing 8 ORDER denying #4 motion. This action appears to be a refiling by Cameron of an action that was previously dismissed by this court as improperly opened as a miscellaneous case. The court concluded in that action that Camerons "filings fall under the purview of a civil action and do not meet the types of matters for assignment as a miscellaneous case." See 21-mc-101 (doc. no. 12). The miscellaneous "docket is restricted for specified matters that are not civil actions." Rytlewski v. Gov't of United States, No. 20-CV-8543 (LLS), 2020 WL 6586373, at *1 (S.D.N.Y Nov. 9, 2020), appeal dismissed (Feb. 9, 2021); see also, District Court Clerks Manual, published by the Administrative Office of the United States Courts 4.03(a). In this case, Cameron appears to be asking this court to enforce, redress, and protect his individual rights under laws that are civil in nature. As such, the court concludes that this action was again improperly filed as a miscellaneous case. As instructed by this court in the previous action, if Cameron seeks to commence a civil action, he must file a civil complaint and pay the appropriate filing fee of $402.00. Therefore, the court denies Camerons motion (doc. no. 4) and the case is dismissed without prejudice to Cameron filing a new civil action in compliance with the courts ruling in 21-mc-101 (doc. no. 12). The clerk is directed to close this case and shall mail a copy of this order, the courts ruling in 21-mc-101 (doc. no. 12), and a civil complaint form to Cameron at his address of record.
