Filing 6 ORDER granting #1 Motion to Stay. On June 1, 2022, this Court filed an order requesting that opposition briefs to a similar motion to stay filed in a related case, In re The Nash Engineering Company, 3:22-CV-00714 (VAB), be submitted by June 2, 2022 at 12 PM ET. The Court did not receive any opposition briefs, and today granted the motion to stay in that case.Having received no opposition to the motion to stay in the related case, and having concluded that the factors for determining whether to grant a stay weigh in favor of granting the stay in this case, see Hirschfeld v. Board of Elections in the City of N.Y., 984 F.2d 35, 39 (2d Cir. 1993) ("In this Circuit, four factors are considered before staying the actions of a lower court: (1) whether the movant will suffer irreparable injury absent a stay, (2) whether a party will suffer substantial injury if a stay is issued, (3) whether the movant has demonstrated a substantial possibility, although less than a likelihood, of success on appeal, and (4) the public interests that may be affected." (internal citation and quotation marks omitted)), the Court GRANTS the #1 Motion to Stay.Responses to the appeal shall be filed by July 1, 2022 and any replies shall be filed by July 15, 2022. A hearing will be held on July 27, 2022 via Zoom. Zoom information to follow.The Court is aware of related cases in Docket Nos. 3:22-cv-00714 and 3:22-cv-00726. To the extent practicable, the parties are encouraged to file consolidated briefs in each of the cases and they will be treated as related to all cases without formal consolidation, at least, at this stage of the process.
