Filing 9 ORDER: It appears as though the pro se plaintiff's complaint (ECF No. 1) is subject to dismissal as frivolous. A district court "may dismiss a frivolous complaint sua sponte even [where, as here] the plaintiff has paid the required filing fee." Fitzgerald v. First E. Seventh St. Tenants Corp., 221 F.3d 362, 364 (2d Cir. 2000) (per curiam). "A complaint is frivolous when '(1) the factual contentions are clearly baseless...; or (2) the claim is based on an indisputably meritless legal theory.'" Jordan v. New York State Dep't of Lab., 811 F. App'x 58, 59 (2d Cir. 2020) (quoting Livingston v. Adirondack Beverage Co., 141 F.3d 434, 437 (2d Cir 1998)). Here, it appears as though the plaintiff is raising constitutional claims against private parties. "Because the United States Constitution regulates only the Government, not private parties, a litigant claiming that [her] constitutional rights have been violated must first establish that the challenged conduct constitutes 'state action.' [S]tate action requires both an alleged constitutional deprivation caused by the exercise of some right or privilege created by the State or by a rule of conduct imposed by the State or by a person for whom the State is responsible, and that the party charged with the deprivation must be a person who may fairly be said to be a state actor." Flagg v. Yonkers Sav. & Loan Ass'n, FA, 396 F.3d 178, 186 (2d Cir. 2005) (internal citations and quotation marks omitted) (emphasis in original). The complaint, however, does not allege any facts suggesting that the defendants are state actors.
