By order dated January 4, 2023, the Court advised Mr. Pelletier that, in order to proceed, he must pay the filing fee or submit a Motion for Leave to Proceed in Forma Pauperis by February 3, 2023. ECF No. 3. The Court informed Mr. Pelletier that his case will be subject to dismissal if he failed to do so. To date, Mr. Pelletier has not complied with this order or sought an extension of time in which to do so. Accordingly, this case is DISMISSED without prejudice.
