March 9, 2023 Docket Entry Correction re 9 Order to Show Cause: Entered in error. (Velez, F.)
March 8, 2023 Opinion or Order Filing 10 ORDER OF DISMISSAL. On February 6, 2023, the court entered an order to show cause as to why the action should not be dismissed. Plaintiff has not filed any objection or other response to the show cause order by the deadline of March 6, 2023. In the absence of any objection or response, the court hereby dismisses this action for the reasons stated in the court's order to show cause, and where the complaint is subject to dismissal under 1915(e)(2)(B). Plaintiff's motion for leave to proceed in forma pauperis (ECF No. #2 ) hereby is denied. The Clerk of Court shall close this case. It is so ordered. Signed by Judge Omar A. Williams on 3/8/2023. (Mamillapalli, S.).
March 8, 2023 Opinion or Order Filing 9 ENTERED IN ERROR: ORDER TO SHOW CAUSE. Under 28 U.S.C. section 1915(e), courts are required to dismiss any action that is frivolous or that fails to state a claim upon which relief can be granted. The complaint seems to allege that the defendants have used unlawful tactics to deprive Plaintiff of her assets and her rights, but it is not clear what rights were infringed or what assets taken, or even the events leading to the deprivation. The court cannot discern a cognizable claim in the allegations. Moreover, it is not clear that, even if there is a cognizable claim, federal jurisdiction is proper. Therefore, Plaintiff is instructed to show cause on or before April 5, 2023, why this case should not be dismissed. Failure to comply with this order will result in dismissal of the action. It is so ordered. Signed by Judge Omar A. Williams on 03/08/23. (Codeanne, K.) Modified on 3/9/2023 to indicate entered in error (Velez, F.).
