February 3, 2023 Opinion or Order Filing 4 ORDER denying #2 Motion for Leave to Proceed In Forma Pauperis. Although Plaintiff's handwriting is difficult to read, he appears to represent that he earns $700 in gross weekly income. As a result, the Court cannot determine that the burden of paying the fees for filing and service would either hamper Plaintiff's ability to obtain the necessities of life or force him to abandon this action. See Adkins v. E.I. DuPont de Nemours & Co., 335 U.S. 331, 339-40 (1948); Potnick v. E. State Hosp., 701 F.2d 243, 244 (2d Cir. 1983) (per curiam). Plaintiff's request to proceed in forma pauperis is therefore denied. In order for this action to proceed, Plaintiff must pay the filing fee by February 24, 2023. The Court will not take any further action in this case until Plaintiff pays the filing fee, and it will dismiss this action if Plaintiff does not do so by February 24, 2023.
