Filing 21 ORDER denying #19 MOTION to Strike. Defendant has filed an offer of judgment under seal. See ECF No. #16 . Plaintiff seeks to strike that document on the grounds that Defendant has failed to comply with the Local Rules, which require all sealed judicial documents to be accompanied by a motion to seal. See D. Conn. L. Civ. R. 5(e) ("No judicial document shall be filed under seal, except upon entry of an order of the Court either acting sua sponte or specifically granting a request to seal that document."). Because the offer of judgment is not a judicial document (i.e. a document relevant to the performance of a judicial function and useful to the judicial process), Defendant need not have filed a motion to seal at the time it filed the offer of judgment. See Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119 (2d Cir. 2006) (defining judicial document). The court will never utilize an offer of judgment in adjudicating any case.
