Filing 12 ORDER denying #9 Motion for Extension of Time. The original complaint in this action was filed on February 16, 2023. On that same date, the Clerk of Court issued a summons pursuant to Fed. R. Civ. P. 4. Since then, an amended complaint has been docketed. A defendant must answer or otherwise respond to a complaint within 21 days of being served with the necessary papers or, if the defendant waives service of process, within 60 days of the date the waiver of process form was sent to the defendant. Here, Defendants' motion represents that Defendant Allied Universal would waive service of summons of the amended complaint if the Court granted Plaintiff's motion to amend the complaint, which the Court has done. Accordingly, Defendant Allied Universal will have 60 days from the date that the waiver is sent to respond to the amended complaint. Plaintiff shall promptly docket the executed waiver of service form, at which time the Court will set a deadline of 60 days from the date the waiver form was sent as the response deadline for Defendant Allied Universal.Separately, no representation is made in Defendants' motion that Defendant Cigna Corporation will waive service of summons. Since no proof of service has been docketed as to this Defendant, however, there is currently no deadline to respond to the amended complaint. When Plaintiff dockets an executed service of process form or, alternatively, an executed waiver of service of summons form, the Court will set an appropriate response deadline for Defendant Cigna Corporation.
