April 17, 2023 Opinion or Order Filing 7 ORDER: The Court has become aware that the plaintiff is no longer housed at the Western Correctional Institution in Cumberland, MD, as the Maryland Department of Correction website indicates he is now housed at the Dorsey Run Correctional Facility. Therefore, it is not clear whether the plaintiff received the Court's notice of insufficiency dated March 22, 2023. Accordingly, the clerk is instructed to send a copy of this order, a copy of the Notice of Insufficiency [ECF No. 6], and a blank copy of the application form to the plaintiff at the Dorsey Run Correctional Facility, 2020 Toulson Road, Jessup, MD 20794. The Court will also sua sponte extend the deadline to comply with the Notice of Insufficiency at ECF No. 6 until two weeks from today, May 1, 2023. Failure to comply with the Notice of Insufficiency or this Order by that date may result in the dismissal of this action. The plaintiff is respectfully reminded that, anytime his address changes, he must promptly file a notice of change of address with the clerk of the court. If he does not keep the court promptly and accurately updated on changes in his address, his case may be dismissed for that reason as well. The plaintiff is also reminded, again, that he must carefully and completely fill out the application, including accurately stating the balance of his inmate trust fund account statement. March 22, 2023 Filing 6 NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. 1915(a)(1), permits him to do so if he files an affidavit demonstrating that he is unable to pay the fee. To assist inmate plaintiffs in making this demonstration, the District of Connecticut provides them with a six-page form to be filled out. In this case, the plaintiff submitted the wrong form. Without this form, the Court cannot determine whether he is able to pay.The Clerk of the Court is respectfully directed to mail the plaintiff a copy of the application form at his address of record. The plaintiff is advised that he need not complete pages four and five of the form, since he has filed a habeas petition rather than a civil rights complaint. The plaintiff is also advised, however, that he must carefully and completely fill out the rest of the form, including accurately stating the balance of his inmate trust fund account statement. The plaintiff is thus directed to complete the form and return it to the Clerk of the Court by April 12. If he does not do so, his case may be dismissed. Signed by Judge Thomas O.
