Filing 12 ORDER: On April 17, 2023, the court closed this case because the plaintiff had not complied with an order to file an inmate trust account statement covering at least the period from September 9, 2022 to March 9, 2023. On April 24, 2023, the plaintiff filed a motion requesting reconsideration of this dismissal. In his motion, the plaintiff asserts that he never received this court's order requiring him to resubmit an inmate trust account statement. Along with his motion, the plaintiff has also filed an inmate trust account statement in compliance with this court's prior order. Because the plaintiff has now complied with the court's order to file an inmate trust account statement covering at least the period from September 9, 2022 to March 9, 2023, the court GRANTS his motion for reconsideration (ECF No. #10 ). The Clerk shall reopen this case. The court also GRANTS the plaintiff's motion for leave to proceed in forma pauperis (ECF No. #2 ). A federal law, 28 U.S.C. 1915, permits the plaintiff to proceed in forma pauperis by filing an affidavit and a certified copy of his inmate trust account statement demonstrating that he is "unable to pay" the $402.00 filing fee. The plaintiff's recently filed inmate trust account statement shows that he had a current balance of just $35.15 when he initiated this action. See ECF No. #11 at 2. And the plaintiff's properly submitted affidavit indicates that he possesses no other financial assets of consequence. See ECF No. #2 at 2-3. The plaintiff is, thus, granted in forma pauperis status.
