Filing 32 ORDER GRANTING MOTIONS TO STAY DISCOVERY (Docs. #24 , #27 ). The defendants have moved to stay discovery and their discovery planning and reporting obligations under Rule 26(f) pending the Court's ruling on their motions to dismiss. A court has discretion to grant a motion to stay discovery pending consideration of a dispositive motion to dismiss and in light of the apparent strength of the dispositive motion, the breadth of discovery sought, and in the absence of prejudice to the non-moving party. See Johnson v. Gonzalez, 2023 WL 2770684, at *3 (D. Conn. 2023). Although the Court has not yet decided whether to grant the defendants' motions to dismiss, it appears that the defendants have raised substantial immunity grounds for dismissal. The plaintiff has not shown that she would suffer any particular prejudice if she is unable to obtain discovery from the defendants until such time that the Court rules on the pending motions to dismiss. Therefore, the Court concludes that the defendants should not have to respond to discovery or other discovery-related obligations until such time that the Court rules on the defendants' motions to dismiss. It is so ordered. Signed by Judge Jeffrey A. Meyer on 5/9/2023. (Reis, Julia) |

Filing 21 ORDER RE PLAINTIFFS OBJECTION TO THE DEFENDANTS MOTIONS FOR EXTENSION OF TIME. The Court has considered plaintiffs objection (Doc. #18 ) to the defendants motions for extension of time (Docs. #13 , #14 ). The Court very commonly grants such motions for a short extension of time to file a responsive pleading to a complaint, and it did not act on grounds of bias or favoritism as plaintiff suggests. The Court has re-evaluated de novo the motion for extension of time in light of plaintiffs objection and concludes again that there was good cause shown to grant the motions for extension of time. It is so ordered. Signed by Judge Jeffrey A. Meyer on 4/12/2023.(Lewis, D) |
