Filing 13 ORDER denying ECF No. #10 , Motion for Reconsideration. Plaintiff labels this submission as both a "motion to reconsider judgment" and an amended complaint. There has been no judgment entered in this action, though, and Plaintiff's submission cannot be accepted as an amended complaint. The court therefore denies the motion, but instructs Plaintiff that she may, if she wishes, file an amended complaint on or before July 5, 2023. The amended complaint should use the same form Plaintiff used before, but state additional facts sufficient to state her claims. Filing 9 ORDER denying ECF No. #2 , Motion to Proceed in Forma Pauperis; dismissing action. Under 28 U.S.C. section 1915(e), courts are required to dismiss any action that is frivolous or that fails to state a claim upon which relief can be granted. The complaint alleges that the defendant has accused the plaintiff of a crime she did not commit, which is the basis for Plaintiff's asserted claims of defamation and gender discrimination. There are insufficient facts stated to support the gender discrimination claim, though, and the court can discern no facts from which it might reasonably conclude that the requirements for diversity jurisdiction are satisfied. Finally, the relief Plaintiff requests is for the court to investigate the matter because it is relevant to other actions she has pending. But this is not a form of relief the court can grant. For all these reasons, the motion must be denied and the complaint must be dismissed, though without prejudice to amendment.
