Filing 12 ORDER. Although Defendant has filed an "opposition to petition to compel arbitration," ECF No. 11, there are two problems with this filing. First, as a preliminary matter, Defendant has not filed a notice of pro se appearance form, which he must do by July 10, 2023. Second, Defendant's filing at ECF No. 11 contains his allegations and arguments regarding the arbitration sought by Plaintiff, but it does not constitute an answer to Plaintiff's complaint. By July 14, 2023, Defendant must file an answer to Plaintiff's complaint, in which Defendant shall list the numbered paragraphs in Plaintiff's complaint and state his response to each paragraph. See Fed. R. Civ. P. 10(b). For example, for each paragraph in the complaint, Defendant can admit the allegations in full or in part, deny the allegations in full or in part, or state that Defendant lacks sufficient knowledge to admit or deny the allegations. Thereafter, if Plaintiff files a motion to compel arbitration pursuant to the Federal Arbitration Act ("FAA"), 9 U.S.C. sec. 4 and/or for appointment of an arbitrator pursuant to the FAA, sec. 5, the parties can file memoranda in support or opposition to the motion pursuant to D. Conn. L. Civ. R. 7. Signed by Judge Sarala V. Nagala on 6/23/2023. (Rennie, Carolyn) |
Filing 10 ORDER denying #2 Plaintiff's motion for an order to show cause. Pursuant to Federal Rule of Civil Procedure 12(a)(1)(A), Defendant shall respond to Plaintiff's petition to compel arbitration, ECF No. 1, after being duly served pursuant to Rule 4. Thereafter, if necessary, Plaintiff may file a motion to compel arbitration pursuant to the Federal Arbitration Act ("FAA"), 9 U.S.C. sec. 4 and/or for appointment of an arbitrator pursuant to the FAA, sec. 5. Signed by Judge Sarala V. Nagala on 6/13/2023. (Rennie, Carolyn) |
