Filing 9 ORDER. In its order to show cause at ECF No. 8, the Court noted that, the day before Plaintiffs filed this case, they initiated a separate action by filing a complaint that appears to be virtually identical to the complaint in this action. See Dunham v. Lions Club Int. Assoc., No. 3:23-cv-561 (SVN). The Court further stated that, if Plaintiffs did not show cause for allowing both actions to proceed by June 9, 2023, this action would be dismissed. To date, Plaintiffs have not attempted to show cause why both actions should proceed. Accordingly, this action is dismissed, and the Clerk is directed to close this case. In light of the dismissal of this action, Plaintiffs' motion to proceed in forma pauperis at ECF No. #2 is denied as moot. Signed by Judge Sarala V. Nagala on 06/13/2023. (Kuegler, Adam) |
Filing 8 ORDER TO SHOW CAUSE. The day before Plaintiffs filed this case, they initiated a separate action, Dunham v. Lions Club Int. Assoc., No. 3:23-cv-561 (SVN), by filing a complaint that appears to be virtually identical to the complaint in this action. Given that this action appears to be duplicative of Plaintiffs' complaint in the separate action, the Court will dismiss this case on June 9, 2023, unless Plaintiffs show cause for allowing both actions to proceed. See Dietz v. Bouldin, 579 U.S. 40, 47 (2016) ("[D]istrict courts have the inherent authority to manage their dockets and courtrooms with a view toward the efficient and expedient resolution of cases."). The Court notes that, if Plaintiffs seek to insert corrections into their complaint in Dunham, No. 3:23-cv-561 (SVN), the proper way to do so is by following the appropriate process for amending their complaint in that action, rather than filing an entirely new action. Signed by Judge Sarala V. Nagala on 05/22/2023. (Kuegler, Adam) |
