May 30, 2023 Opinion or Order Filing 7 ORDER denying #6 Motion to Transfer/Disqualify/Recuse Judge.Parties may move for judicial recusal on account of "a personal bias or prejudice either against [the party] or in favor of any adverse party...." 28 U.S.C. 144; see also 28 U.S.C. 455(b)(1) (requiring judges to disqualify themselves where they have "a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding"). In deciding whether to recuse, "the trial judge must carefully weigh the policy of promoting public confidence in the judiciary against the possibility that those questioning his impartiality might be seeking to avoid the adverse consequences of [the judges] presiding over their case." In re Drexel Burnham Lambert, Inc., 861 F.2d 1307, 1312 (2d Cir. 1988) (internal citation omitted). Mr. Kaddy argues that he should get a new judge, new attorney, and rulings on certain matters because he has been subject to unjust prior proceedings, but Mr. Kaddy has not identified any specific reason the presiding judge should be recused from this case. Mot. for New Judge, ECF No. 6. Therefore, Mr. Kaddy has not met his burden to show that "an objective, disinterested observe fully informed of the underlying facts, [would] entertain significant doubt that justice would be done absent recusal," or that "a reasonable person, knowing all the facts, would question the judges impartiality." United States v. Yousef, 327 F.3d 56, 169 (2d Cir. 2003) (internal citations and quotation marks omitted). Accordingly, the motion for a new judge is DENIED. Signed by Judge Victor A.
