ORDER RE MOTION TO CONSOLIDATE CASES (Doc. #16 ). The plaintiff asks the Court to consolidate this case with another lawsuit he has filed that is currently pending: Traylor v. Pacciuco et al., 3:23-cv-329-JAM (D. Conn.). See Doc. #16 . But the "the plaintiff has no right to maintain two actions on the same subject in the same court, against the same defendant at the same time." Sacerdote v. Cammack Larhette Advisors, LLC, 939 F.3d 498, 504 (2d Cir. 2019). The plaintiff's two cases arise from the same facts, involve the same parties, and seek identical relief. Compare Doc. #14 , with Traylor v. Pacciuco LLC et al., 3:23-cv-329-JAM (D. Conn.), Doc. #92. Accordingly, I shall DENY the plaintiff's motion to consolidate cases (Doc. #16 ) and DISMISS the amended complaint (Doc. #14 ) without prejudice. The Clerk of Court shall close this case.
