Filing 12 ORDER TO SHOW CAUSE WHY CASE SHOULD NOT BE REMANDED. Plaintiff Theodora Antar has filed a notice of removal from Connecticut state court that appears to be defective on its face. Federal law states in part that "[a] defendant or defendants desiring to remove any civil action from a State court shall file in the district court of the United States for the district and division within which such action is pending a notice of removal signed pursuant to Rule 11 of the Federal Rules of Civil Procedure and containing a short and plain statement of the grounds for removal, together with a copy of all process, pleadings, and orders served upon such defendant or defendants in such action." 28 U.S.C. 1446(a). Here the plaintiff has failed to identify the grounds for lawful removal or to file a copy of all process, pleadings, and orders that have been served on the defendant or defendants in the underlying state court action. It is not enough simply to reference a state court docket number. Moreover, it appears that Antar is the plaintiff and not the defendant in the underlying state court action, but the law allows only a defendant to file a notice of removal. Therefore, the Court intends to remand this action to Connecticut state court absent Antar's filing of a response to this order to show cause on or before August 4, 2023 that complies with the law and that explains why removal is proper.
