August 24, 2023 Opinion or Order Filing 21 ORDER OF DISMISSAL. On August 9, 2023, the Court entered an order to show cause why this action should not be dismissed pursuant to 28 U.S.C. 1915(e)(2)(B) and allowing plaintiff an opportunity to file an amended complaint or to explain why the action should not be dismissed. Doc. #19 . Plaintiff has filed a response. Doc. #20 . Her response does not dispute that the complaint does not allege a federal cause of action or other grounds for federal jurisdiction. Although the plaintiff states that she wishes to file an amended complaint that properly alleges a federal cause of action, she has not done so despite the Court's allowance in its order to show cause of an opportunity for her to do so. The Court's order stated that it "shall require by August 23, 2023 that Antar either file an amended complaint that overcomes the concerns set forth in this ruling or file a response explaining why the complaint should not be dismissed." Doc. #19 at 1. Plaintiff has not filed an amended complaint despite stating in her response to the order to show cause that she intended to timely file an amended complaint by August 23, 2023. Doc. #20 at 18. Accordingly, the Court DISMISSES this action for the reasons stated in its order to show cause. Plaintiff's remaining motions (Docs. #2 , #5 , #14 , #15 , #16 ) are DENIED as moot in light of the dismissal of this action. This order of dismissal is without prejudice to the plaintiff's filing of a new action in the event that she has good faith grounds to present a plausible claim for relief for which this Court has jurisdiction. August 9, 2023 Opinion or Order Filing 19 ORDER TO SHOW CAUSE WHY COMPLAINT SHOULD NOT BE DISMISSED: For the reasons stated in the attached order, it appears that the complaint is subject to dismissal under 1915(e)(2)(B) and Fed. R. Civ. P. 12(h)(3) because it does not allege facts to support federal jurisdiction or, to the extent that it cites federal law, it does not allege facts to plausibly suggest any grounds for relief under federal law. But if Antar has grounds to file an amended complaint or to show why the complaint should not be dismissed, she may file a response to this order to show cause by August 23, 2023. It is so ordered.
