ORDER Remanding Matter to State Court. Defendants filed a Notice of Removal with this court on August 7, 2023. See ECF No. #1 . Defendants argue that there is complete diversity jurisdiction among the parties, stating that both Defendants are "residents of Connecticut." Id. at 2. Defendants argue no other basis of jurisdiction. A civil action removable solely on the basis of diversity jurisdiction "may not be removed if any of the parties in interest properly joined and served as defendants is a citizen of the State in which such action is brought." 28 U.S.C. 1441(b)(2). Therefore, as citizens of Connecticut, Defendants cannot remove cases in Connecticut (where this action originally was filed), even though the amount in controversy exceeds $75,000.The case is remanded back to state court.
