Filing 10 ORDER TO SHOW CAUSE. The Court has reviewed Plaintiff's filings in response to its order to show cause at ECF No. 7. Upon further review, the Court notes that Plaintiff Maloney names the Middletown Probate Court as a second defendant in her complaint. ECF No. 1 at 2. To the extent that Plaintiff seeks to challenge a prior state court judgment against her, this Court may lack subject matter jurisdiction under the Rooker-Feldman doctrine. See Ashby v. Polinsky, 328 F. App'x 20, 21 (2d Cir. 2009) (citing Rooker v. Fidelity Trust Co., 263 U.S. 413 (1923), and D.C. Ct. of App. v. Feldman, 460 U.S. 462 (1983)). Accordingly, no later than September 22, 2023, Plaintiff shall show cause why the Rooker-Feldman doctrine would not deprive the Court of subject matter jurisdiction over her claim against the Middletown Probate Court. Filing 7 ORDER TO SHOW CAUSE. The Federal Rules of Civil Procedure provide that, if the Court determines at any time that it lacks subject matter jurisdiction, it must dismiss the action. Fed. R. Civ. P. 12(h)(3). In order for this Court to exercise subject matter jurisdiction, either (1) the plaintiff must set forth a colorable claim arising under the U.S. Constitution or a federal statute, thus invoking this Court's federal question jurisdiction under 28 U.S.C. 1331; or (2) there must be complete diversity of citizenship between the plaintiff and the defendant and the amount in controversy must exceed $75,000 under 28 U.S.C. 1332. See DaSilva v. Kinsho Int'l Corp., 229 F.3d 358, 363 (2d Cir. 2000) (identifying the two categories of subject matter jurisdiction). This action appears to involve two Connecticut residents in a property dispute. Plaintiff also cites a Connecticut identity theft statute. Accordingly, no later than September 1, 2023, Plaintiff shall respond to this order explaining why she believes this Court has subject matter jurisdiction over the instant case.
