October 13, 2023 Opinion or Order Filing 10 ORDER RE AMENDED COMPLAINT. The Court has reviewed the amended complaint and decided that it is not necessarily subject to dismissal at this time. The Court has concerns, however, that the complaint lacks information required under Rule 8 of the Federal Rules of Civil Procedure including a statement of the Court's jurisdiction and a statement of the relief sought. See Fed. R. Civ. P. 8(a)(1), 8(a)(3). In addition, the allegations of the complaint appear to go into details well beyond what is needed for "a short and plain statement of the claim," see id. 8(a)(2), and the complaint lacks any allegations with respect to individual claims for relief and under which particular provisions of the law. It is likely that in the event that the defendant is served with the complaint and files a motion to dismiss, the Court may grant a motion to dismiss because of the defects in the complaint. Therefore, if plaintiff wishes to avoid substantial delay and possible dismissal of his complaint, the Court strongly recommends that plaintiff (1) retain counsel to draft a proper amended complaint or (2) promptly contact the Federal Pro Se Legal Assistance program for assistance from attorney Cat Itaya with respect to the drafting and filing of an amended complaint that may stand a better chance to withstand a motion to dismiss.
