ORDER. Plaintiff has filed a complaint against defendant for negligence and breach of contract. The defendant has been served and is due to file an answer or other response to the complaint by October 4, 2023. In the meantime, plaintiff has filed two motions for an order and for a ruling (Docs. #2 , #10 ). A party seeking a temporary restraining order or preliminary injunctive relief pending resolution of the merits of a lawsuit "must generally show a likelihood of success on the merits, a likelihood of irreparable harm in the absence of preliminary relief, that the balance of equities tips in the party's favor, and that an injunction is in the public interest." Am. Civil Liberties Union v. Clapper, 804 F.3d 617, 622 (2d Cir. 2015). Because plaintiff has not shown the requisites for a grant of a preliminary injunction or other interim relief, the Court DENIES the motions for an order and a ruling in plaintiff's favor (Docs. #2 , #10 ). The Court will not be prepared to enter a ruling on the merits of this action until such time that the defendant has had a full opportunity to file a response. It is so ordered.
