Filing 9 ORDER OF DISMISSAL. On September 26, 2023, the Court entered an order denying plaintiff's motion for leave to proceed in forma pauperis (Doc. #2 ). Because plaintiff has not filed the filing fee, an amended motion, or other response by the deadline set by the Court, the Court DISMISSES this action without prejudice for plaintiff's failure to pay the filing fee. Filing 8 ORDER DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS (Doc. #2 ). Plaintiff has filed this action pro se and has moved for leave to proceed in forma pauperis. Her affidavit demonstrates that plaintiff earns a gross weekly income of $600 (approximately $2,500 per month) as an employee of Yale New Haven Health, that she has no dependents, and owns a 2014 Toyota automobile. She has listed monthly expenses of about $2,000. It appears that plaintiff has a positive monthly income and so she has not demonstrated that payment of the filing fee would impose substantial hardship or require foregoing the necessities of life. See Potnick v. Eastern State Hosp., 701 F.2d 243, 244 (2d Cir. 1983) (per curiam). Nor has she signed the motion form as required to attest to its accuracy. On this record, I cannot conclude that plaintiff qualifies for in forma pauperis status. Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #2 ). The plaintiff shall pay the filing fee on or before October 27, 2023 (subject to extension upon motion) or this action shall be dismissed. It is so ordered. Signed by Judge Jeffrey A.
