November 8, 2023 Opinion or Order Filing 9 ORDER of DISMISSAL WITHOUT PREJUDICE. On October 2, 2023, the Court informed Plaintiff that her case would be subject to dismissal unless the Court received the requisite filing fee or a motion to proceed in forma pauperis by November 1, 2023. ECF No. 8. To date, Plaintiff has not complied with the Court's order, nor has she filed a motion for extension of time to do so. Thus, the Court DISMISSES this action without prejudice. This dismissal is without prejudice to Plaintiff filing a motion to reopen this case on or before January 5, 2024. Plaintiffs motion to reopen must explain the reasons for her non-compliance with the Courts earlier orders and include the $402.00 filing fee or a motion to proceed in forma pauperis, in compliance with the Court's prior orders. If Plaintiff does not file a motion to reopen with a new motion to proceed in forma pauperis or pay the filing fee of $402.00 by January 5, 2024, the Court will convert this dismissal to one with prejudice. The Clerk is directed to close this case. Signed by Judge Sarala V. Nagala on 11/8/23.(Hagemann, Emma)
