Filing 11 ORDER denying ECF No. #10 , Motion to Reopen Case. Plaintiff appears to believe that this action was dismissed because he had not updated his address, but that is not the case. The court found that Plaintiff had not stated an actionable claim in the complaint. See ECF No. 9. That deficiency has not been corrected. Accordingly, the motion must be denied. Filing 9 ORDER dismissing complaint. Under 28 U.S.C. Section 1915(e), courts are required to dismiss any action that is frivolous or that fails to state a claim upon which relief can be granted. After careful review of the complaint, the court cannot find a cognizable federal claim amongst the factual allegations. Plaintiff claims to be the victim of a theft and an assault, each of which he reported to the police, but neither of which resulted in any investigation, or at least, not as much investigation as the plaintiff would like. The court gathers that Plaintiff intends to state a civil rights claim, but there is no recognized cause of action against law enforcement for a failure to investigate. See Harrington v. Cnty. of Suffolk, 607 F.3d 31, 35 (2d Cir. 2010) ("[W]e have no trouble concluding that plaintiffs do not have a protected property interest in an investigation....") Accordingly, the action must be dismissed. Plaintiff may file an amended complaint if he wishes. Resources and assistance for self-represented parties can be requested through the Clerk's Office, or by contacting the New Haven Legal Assistance Association, Inc.
