The Court also construes the #17 Affidavit filed as a request to attach the affidavit as an exhibit to his Complaint, and that request is likewise granted. Plaintiff is Ordered to file an Amended Complaint containing all claims and naming all defendants on or before December 6, 2023. Initial Review will be conducted once the operative Amended Complaint is filed. The Court construes Plaintiff's #8 Motion for Medical Treatment and #18 Motion for Temporary Relief as motions for a mandatory injunction. Plaintiff fails to meet the rigorous standards of Federal Rule of Civil Procedure 65(b)(1), which precludes the Court from issuing an order without notice to the adverse party unless the movant alleges specific facts showing he will suffer "immediate and irreparable injury, loss, or damage" before the adverse party can be heard in opposition. Id. Rule 65(b)(1) further requires a plaintiff to certify in writing any efforts to give notice and reasons why notice should not be required. See id. The motions are denied without prejudice to refiling once the Court's Initial Review Order is issued, and Defendants are identified, served, and appearing through counsel. Plaintiff's #12 Motion in Limine is denied without prejudice. This case is still in the initial review stage. If, in the future, a hearing or trial is scheduled, Plaintiff may renew his motion in limine.
