Filing 7 ORDER re Motion for Leave to Proceed in forma pauperis. The Court notes that plaintiff has two cases on the docket, both titled Baker v. Quiros; the Clerk docketed one under case number 23-cv-1436, and the other under case number 23-cv-1454. The complaints in the two cases appear to be identical. The Court is unsure whether the plaintiff intended to file two cases, or whether instead this was simply a mix up in the Clerk's Office. Mr. Baker is respectfully advised that if he files two cases, he will ultimately be liable for two filing fees, even if his motion to proceed in forma pauperis is granted. See 28 U.S.C. 1915 (stating that incarcerated persons who are granted in forma pauperis status are not relieved from paying the filing fee entirely, but may pay it over time from their inmate trust accounts).Mr. Baker is ordered to file, by December 28, 2023, a notice on the docket in the 23-cv-1454 case, stating whether he intended to file two actions and incur two fee liabilities. If he did not intend to do so, the undersigned will deny the motion for leave to proceed in forma pauperis in the 23-cv-1454 case, Mr. Baker having already been granted leave to proceed in forma pauperis in the 23-cv-1436 case.
