Filing 14 VACATED AT DKT. 15 -- ORDER. Pursuant to Federal Rule of Civil Procedure 7.1, a disclosure statement must be filed with a party's first appearance, pleading, petition, motion, or other request addressed to the Court and must be supplemented if any required information changes during the case. See ECF No 2. Counsel have appeared on behalf of Celtic Bank, Applied Bank, WebBank, LVNV Funding LLC, and Resurgent Capital Services, LP, but to date no disclosure statements have been filed by these Defendants. Filing 13 ORDER DISMISSING CASE. Plaintiff has filed a motion seeking to "remove [his] claim from the docket file." The Court interprets this motion as a notice of voluntary dismissal of the action. The Clerk is therefore directed to administratively close this case, without prejudice to Plaintiff filing a motion to reopen the case on or before February 2, 2024, if the Court has misinterpreted his request. The deadline for moving to reopen this action may be extended for good cause, upon a motion filed in accordance with Local Rule 7(b).Signed by Judge Sarala V. Nagala on 1/3/2024.(Hagemann, Emma) |
Filing 12 NOTICE of Voluntary Dismissal, by Christian Borrero. (Mendez, D) |
Set deadline: amended complaint due by 1-3-2024 per Dkt. 11 Order. (Shafer, J.) |
Filing 11 ORDER. The Court notes that Plaintiff has filed a "notice," see ECF No. 10, which appears to supplement the allegations contained in his Complaint. To the extent Plaintiff's "notice" is an attempt to amend or supplement the Complaint, Plaintiff is advised that any amended pleading generally "replace[s] and supercede[s] in its entirety the previous complaint." Bennett v. Fletcher, No. 917CV849GTSCFH, 2018 WL 557885, at *1 (N.D.N.Y. Jan. 18, 2018). The purpose of this rule is to "ensure that all of the allegations asserted against the defendants are contained in a single document, thereby reducing the likelihood that a party will overlook one or more allegations against him" and to "eliminate[] the confusing nature of 'piecemeal' amended complaints." Id. If Plaintiff wishes the Court to consider the allegations outlined in his supplemental filing, the Court will permit him an opportunity to file one amended complaint prior to issuing an initial review order under 28 U.S.C. Section 1915A. Any amended complaint must be filed by January 3, 2024. If no amended complaint is filed by January 3, 2024, the Court will examine the original complaint at ECF No. 1 for purposes of the initial review order, but will not examine the notice at ECF No. 10.
