Filing 8 RECOMMENDED RULING Denying #2 MOTION for Leave to Proceed in forma pauperis filed by Marquese Hines. Objections due by 12/26/2023.Plaintiff has filed a motion seeking to proceed without payment of fees and costs, along with a financial affidavit. Plaintiff has substantially completed the required information, albeit predominantly with indecipherable handwriting. However, it appears that that Plaintiff represented under penalty of perjury: (1) that he generates $6,000 to $8,000 per week in pre-tax income from his self-employment; (2) that he has $0 in monthly obligations; and (3) that his real propertys estimated value is $85 million (but see Hines v. Leah Arihess Family et al, No. 23-cv-1571-VAB, in which the same Plaintiff contemporaneously filed another financial affidavit attesting that his real property is worth approximately $250 million). Based on Plaintiffs own representations, this Court finds that Plaintiff--with $85 million of assets, no liabilities, over $6,000 of weekly income, and no obligations--is able to afford to pay the ordinary $402 filing fee required by the Court. 28 U.S.C. 1915(a)(1). Accordingly, Plaintiff must either pay the filing fee or object to this recommended ruling by December 25, 2023, or his case may be dismissed.This is a recommended ruling. See Fed. R. Civ. P. 72(b)(1). Any objections to this recommended ruling must be filed with the Clerk of the Court on or before 12/26/2023. See Fed. R. Civ. P. 72(b)(2) (objections to recommended ruling due fourteen days after being served); Fed. R. Civ. P. 6(d) (three days added where service is by mail); Fed. R. Civ. P. 6(a)(1)(c) (extending a deadline that otherwise would fall on a legal holiday). Failure to object by that date will preclude appellate review. See 28 U.S.C. 636(b)(1); Fed. R. Civ. P. 72 and 6(a); D. Conn. L. Civ. R. 72.2; Small v. Secretary of H.H.S., 892 F.2d 15 (2d Cir. 1989) (per curiam); F.D.I.C. v. Hillcrest Assoc., 66 F.3d 566, 569 (2d Cir. 1995).Signed by Judge Maria E.
