February 7, 2024 Opinion or Order Filing 11 ORDER granting #9 Plaintiff's Motion for Leave to Serve a Third-Party Subpoena Prior to a Rule 26(f) Conference, subject to the limitations and protective order in the attached Order, for the purpose of determining the identify of the alleged infringer, Defendant Doe. Note that some of the limitations and terms of the protective order differ from those the Court has entered in previous cases involving Plaintiff.The Court's Standing Order on Pretrial Deadlines, ECF No. 5, is hereby vacated. The parties' Rule 26(f) Report shall be due under the deadlines established in Local Rule 26(f), which requires the filing of a Rule 26(f) Report within 44 days after the appearance of a defendant in the case. The Court will set all further deadlines after consideration of the Rule 26(f) Report.Plaintiff shall notify the Court within seven days of identifying Defendant Doe. If Defendant has not been identified by April 8, 2024, Plaintiff shall file a status report regarding the progress of its efforts to identify Defendant on April 8, 2024. The Court further orders that the complaint shall be served within 90 days of Plaintiff's receipt of the identity of Defendant through the subpoenaed documents.
