January 3, 2024 Filing 5 NOTICE OF INSUFFICIENCY. The petitioner has filed a motion for leave to proceed in forma pauperis; in other words, she seeks to commence a federal habeas case without paying the $5.00 filing fee. A federal law, 28 U.S.C. 1915, permits her to do so if, among other things, she files an affidavit demonstrating that she is unable to pay the $5.00 fee. To assist inmate plaintiffs in making this demonstration, the Administrative Office of the United States Courts has prepared a two-page application form. In this case, the petitioner submitted an affidavit reflecting that she did not have $5.00 in her inmate account, however this statement does not encompass any funds plaintiff may have stored elsewhere. Therefore, the Court is unable to determine whether she is able to pay $5.00.The Clerk of the Court is respectfully directed to mail the petitioner a copy of the AO240 application form at her address of record. If the petitioner contends that she is unable to pay the $5.00 filing fee applicable to habeas matters, she must complete all pages of the form and return it to the Clerk of the Court by January 24, 2024.
