The Court finds that (i) the motion was timely filed, (ii) Coinmint has a direct, substantial, and legally protectable interest in using counsel of its choice and evidence gathered by that counsel in the underlying arbitration and other adversarial proceedings, (iii) disposition of DeNaut's objections to the subpoena could impair or impede Coinmint's ability to protect that interest, and (iv) no existing parties will adequately protect that interest. See Fed. R. Civ. P. 24(a)(2); see also Brennan v. N.Y.C. Bd. of Educ., 260 F.3d 123, 129 (2d Cir. 2001) (reciting four-factor test and expounding on requirement of "direct, substantial, and legally protectable" interest). The Court further finds that Coinmint's intervention will not disrupt this Court's diversity jurisdiction under 28 U.S.C. 1332 for the obvious reason that Coinmint (Puerto Rico) is diverse from both Katena (Delaware/California) and DeNaut (Connecticut).
