Filing 9 ORDER re #7 Non-party Debra Duguid's Objection. The objection filed by Ms. Duguid is sustained, in part, and overruled, in part. To the extent that Charter possesses responsive documents to KPM's subpoena which contain clearly personal and private information, such information should be appropriately redacted. As indicated by KPM in its response, "KPM would of course [] agree[] that social security numbers, bank account numbers, credit card numbers, and other irrelevant sensitive information could be partially redacted, leaving the last four digits unredacted." (Dkt. #8 at 4.) In conjunction with the protective order in place in the underlying litigation and the designation of any information produced in response to the contemplated subpoena as "Highly Confidential-Attorney's Eyes Only," Ms. Duguid's privacy concerns should be assuaged as it relates to this private information. However, the objection is overruled as it relates to the information concerning the "number and types of devices connected" to the designated IP address. The existence and use of electronic devices does not on its own, without some other compelling reason beyond unarticulated phishing concerns, justify further redaction or withholding of information. Should the parties have any further disagreements regarding the subpoena requests at issue in this matter, the parties are to meet and confer regarding their dispute prior to filing further motions.
