ORDER. Having considered Defendant/Counterclaimant Jet Support Services, Inc.'s ("JSSI") Motion to Compel Compliance with Non-Party Subpoena under Rule 45 of the Federal Rules of Civil Procedure, ECF No. 1, the Court orders the following:The motion to compel, is GRANTED. Under Local Rule 37(d), MTU Aero Engines AG ("MTU") has 14 days to comply with this order. With respect to a deposition, MTU shall make a representative available within 45 days of the entry of this order, and within 14 days of the entry of this order, MTU shall communicate (1) the date on which MTU will make the representative available for a deposition, (2) the name of the representative, and (3) a list of topics on which the representative will be prepared to testify. With regard to JSSI's motion for attorneys' fees and costs, JSSI shall provide, within 14 days of the entry of this order, an itemized list of attorneys fees and costs incurred as a result of filing the motion to compel. Within 14 days thereafter, MTU may file a response to the motion for attorneys' fees and costs, in which it may object to the granting of attorneys' fees and costs generally as well as to the specific itemized expenses provided by JSSI. JSSI shall serve a copy of this order by registered mail with return receipt requested on the Rocky Hill, Connecticut entity and shall provide, in the same manner, a copy to at least one other entity listed on pages three and four of its memorandum (ECF No. 1-1 at 3-4).
