February 21, 2024 Opinion or Order Filing 16 ORDER granting #15 Motion to Remand to State Court. Federal courts have subject matter jurisdiction only over matters in which a federal question is raised or there is diversity of citizenship. See 28 U.S.C. 1331, 1332. Federal question jurisdiction exists where the action "aris[es] under the Constitution, laws or treaties of the United States." 28 U.S.C. 1331. "[A] suit 'arises under' federal law... 'only when the plaintiff's statement of his own cause of action shows that it is based upon [federal law].'" Vaden v. Discover Bank, 556 U.S. 49, 60 (2009) (quoting Louisville & Nashville R. Co. v. Mottley, 211 U.S. 149, 152 (1908)). Defendants removed this case to federal court on January 12, 2024, insofar as Plaintiff brought claims pursuant to Title VII of the Civil Rights Act, thus invoking this Court's federal question jurisdiction. On January 22, 2024, Plaintiff amended her complaint as a matter of course, in accordance with Fed. R. Civ. P. 15, eliminated all claims seeking relief pursuant to federal statute, and sought remand of the case back to state court. See ECF Nos. 14, 15. Defendants have not opposed remand. Further, the Court sees no reason to exercise supplemental jurisdiction over the various state law claims in the absence of original jurisdiction. See, Certilman v. Becker, 807 F. Supp. 307, 308309 (S.D.N.Y. 1992). Accordingly, Plaintiff's motion to remand is GRANTED. The Clerk of the Court is directed to: (1) remand this matter to the Connecticut Superior Court, Judicial District of Bridgeport pursuant to 28 U.S.C. 1447(c), and (2) close this case.
