March 6, 2024 Opinion or Order Filing 22 ORDER finding as moot #18 Motion to Dismiss Counsel. As an initial matter, it is noted that counsel has not been appointed to represent the plaintiff in this case but instead on another matter which was also before the undersigned for settlement. See Rogers v. Cusson, 21-cv-1710 (OAW). Had the plaintiff filed the motion in the appropriate action, however, the Court finds that the motion would still be moot. The plaintiff participated in a settlement conference on March 5, 2024, during which this case was settled as part of a global settlement. The plaintiff was assisted during that conference by appointed counsel who is the subject of this motion. As the circumstances regarding counsel's representation regarding settlement have resolved and the case has, in fact, settled, the Motion to Dismiss Counsel is hereby found to be moot.
