March 28, 2024 Opinion or Order Filing 8 ORDER DISMISSING CASE: On February 6, 2024, this Court issued an order notifying Petitioner that this action would be dismissed if, by March 7, 2024, he had not (1) paid the filing fee or (2) filed an application to proceed in forma pauperis (IFP). (Dkt. No. 2 ). On March 13, 2024, this Court again warned Petitioner that the case was subject to dismissal if a filing fee or updated IFP was not received by March 27, 2024. To date, Petitioner has not paid the filing fee or filed an updated IFP application.Federal Rule of Civil Procedure 41(b) authorizes a district court to dismiss a complaint for failure to comply with a court order, treating the noncompliance as a failure to prosecute. Simmons v. Abruzzo, 49 F.3d 83, 87 (2d Cir. 1995). Petitioner has not complied with this Court's order to pay the filing fee or update the IFP and was warned of the risk of dismissal. Accordingly, pursuant to Fed. R. Civ. P. 41(b), this case is DISMISSED without prejudice, for failure to comply with a court order. The Clerk is directed to close this case.
