ORDER denying #5 Motion for Temporary Restraining Order. To the extent Plaintiff seeks an ex parte temporary restraining order, issued without notice to the Defendant, this request for relief is DENIED. The Court may issue a temporary restraining order without written or oral notice to the defendant or his attorney only if Plaintiff demonstrates that it will suffer irreparable injury, loss or damage "before the [defendant] can be heard in opposition," and Plaintiff's attorney "certifies in writing any efforts made to give notice and the reasons why it should not be required." See Fed. R. Civ. P. 65(b)(1)(A) and (B). Here, no such certification was submitted. The requirements of Rule 65(b) must be scrupulously observed. See Austin v. Altman, 332 F.2d 273, 275 (2d Cir. 1964). The motion for a temporary restraining order is therefore denied. See also, Little Tor Auto Ctr. v. Exxon Co. USA, 822 F. Supp. 141, 143 (S.D.N.Y. 1993) ("Ex parte relief under [Rule] 65 by way of a temporary restraining order is an emergency procedure."). Notwithstanding, and given the potential for imminent harm to Plaintiff as set forth in the motion, a hearing on the request for a preliminary injunction is scheduled for February 20, 2024.
