Filing 15 ORDER OF REFERRAL. The Court REFERS plaintiff's renewed motion for leave to proceed in forma pauperis (Doc. #12 ) to Judge Richardson to conduct a hearing or such other inquiry as he deems appropriate to verify plaintiff's representations that he is unable to pay the filing fee. It is so ordered. Signed by Judge Jeffrey A. Meyer on 3/26/2024.Motions referred to Robert A. Richardson(Lewis, D) |

Filing 12 Second MOTION for Leave to Proceed in forma pauperis by Stephen J. Williams. (Attachments: #1 Affidavit, #2 Exhibit)(Williams, Stephen) |
Filing 11 ORDER DENYING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS (Doc. #2 ). The Court DENIES without prejudice plaintiff's motion for leave to proceed in forma pauperis for failure to properly and fully complete the affidavit form. For example, the affidavit states NONE for "Your Employment" but fails to complete the information for "unemployed" status including name and address of last employer. The affidavit also leaves blank all lines for monthly expenses except for "$30" for transportation expenses. The affidavit is deficient notwithstanding the instructions at the top of the form: "Do not leave any blanks" and that "Failure to follow these instructions may result in the denial of your Motion." Nor does the affidavit include any information in response to the form query to "Provide any other information that will help explain why you cannot pay the costs of these proceedings." In addition, it appears from plaintiff's submission that he is an attorney and member of the federal bar of Connecticut, which suggests both that he has opportunities to be gainfully employed and that he should have the ability to properly complete a form for a motion for leave to proceed in forma pauperis. Accordingly, the Court DENIES without prejudice the motion for leave to proceed in forma pauperis. Plaintiff may file a proper renewed motion or pay the filing fee on or before March 15, 2024. Failure to timely pay the filing fee or to file a proper renewed motion may result in dismissal of the complaint. It is so ordered. Signed by Judge Jeffrey A. Meyer on 2/15/2024. (Lewis, D) |
