Filing 14 ORDER granting #12 Motion to Stay. On March 8, 2024, the parties filed a joint Motion to Stay proceedings in this case, to permit the parties to complete an appraisal of the plaintiffs' damaged property, thereby conclusively establishing the amount of loss and damage under the insurance policy at issue in this litigation. (See Doc. No. #12 ). Insofar as "there is no coverage dispute," and the completion of the appraisal "will eliminate some issues in the litigation and will promote settlement of the remaining issues," the Court finds good cause to stay these proceedings pending completion of the appraisal. (Id. at 3-4); see, e.g., Victor's Cafe 52nd St., Inc. v. Travelers Indem. Co. of Am., No. 22-CV-7223 (SN), 2023 WL 3871887, at *3 (S.D.N.Y. May 22, 2023) (compelling appraisal and staying proceedings pending the outcome of appraisal in "a case where only the amount of [p]laintiff's remaining property claim is at issue"). Moreover, the parties have jointly indicated that a stay of proceedings would not harm or prejudice either party. (See Doc. No. #12 at 4). For the foregoing reasons, the Motion to Stay is hereby GRANTED. This case is stayed until June 17, 2024. On June 13, 2024, the parties shall file a Joint Status Report advising the Court as to the status of the appraisal, and whether or not a continuation of the stay is warranted.
