ORDER TO SHOW CAUSE re #1 Complaint. Under Fed. R. Civ. P. 12(h)(3), the Court must dismiss an action if it determines that it lacks subject matter jurisdiction. "[A] court must satisfy itself that it has subject matter jurisdiction and may at any time in the course of litigation consider whether such jurisdiction exists." Mitskovski v. Buffalo & Fort Erie Pub. Bridge Auth., 435 F.3d 127, 133 (2d Cir. 2006). If necessary, where jurisdiction is questionable, a court may examine its subject matter jurisdiction sua sponte. Joseph v. Leavitt, 465 F.3d 87, 89 (2d Cir. 2006). According to the Complaint, there is diversity jurisdiction because "the matter is controversy exceeds the sum of $75,000.00" and the parties' citizenship is completely diverse. (ECF No. #1 1, 2.) However, Plaintiffs are alleged to be citizens of Connecticut, Florida, California, and Texas, and Defendants are alleged to have their principal places of business also in Texas. (Id. 4-22.) Here, the Complaint does not properly allege this Court's diversity jurisdiction. Federal courts only have diversity jurisdiction when there is complete diversity between the partiesthat is, when all plaintiffs are citizens of different states from all defendants. See 28 U.S.C. 1332; Lincoln Prop. Co. v. Roche, 546 U.S. 81, 89 (2005). Further, "a corporation shall be deemed to be a citizen of any State by which it has been incorporated and of the State where it has its principal place of business[.]" 28 U.S.C. 1332(c)(1). Accordingly, Plaintiffs shall file a letter of no more than three (3) pages by July 1, 2024 showing cause why this Court should retain subject matter jurisdiction over this action. The submission shall include relevant information regarding the parties' citizenships and legal authority to support their position. It is so ordered. Signed by Judge Vernon D.
