ORDER granting #1 Application to Take Discovery pursuant to 28 USC 1782. The applicant, Moussy Salem, proposes to serve a document subpoena on UBS AG in support of judicial proceedings in England. Counsel for UBS attended the 2/7/24 status conference and represented that UBS does not object to the granting of the Application and that UBS counsel will accept service of the subpoena, subject to a reservation of the right to assert all other objections. Counsel for the Salem and UBS confirmed that they will meet and confer in an effort to resolve any disagreements prior to seeking judicial intervention. Accordingly, the Application is granted. Salem may serve the subpoena with a response deadline of not less than 28 days and also may issue additional subpoenas for the production of documents and/or depositions as reasonably appropriate. Service of the subpoena may be effectuated on UBS counsel as agreed, and all other provisions of Rule 45 shall apply as in the ordinary course.
