Filing 16 ORDER: On May 20, 2024, consistent with the Court's instructions (see Doc. No. 12), the parties filed a Joint Status Report ("JSR"). (Doc. No. #15 ). Having reviewed the JSR, and in light of the parties' enlarged discovery deadline in the underlying EDPA case (see id.), the Court hereby sets the following interim deadlines: (1) on or before July 11, 2024, the plaintiff shall conduct a deposition of non-party The Hartford's corporate representative pursuant to Rule 30(b)(6) of the Federal Rules of Civil Procedure; and (2) on or before July 28, 2024, the parties shall file another JSR in this matter advising as to the status of the plaintiff's dispute with non-party The Hartford following the 30(b)(6) deposition. Filing 12 ORDER denying #1 Motion to Compel Subpoena Compliance. On May 16, 2024, the Court held a Discovery Conference regarding the plaintiff's Motion to Compel. (See Doc. Nos. 5, 7). As instructed, counsel for both the defendant, as well as non-party The Hartford, were present. (See id.). At the conclusion of today's conference, the parties agreed upon a provisional resolution of the plaintiff's Motion to Compel, whereby the plaintiff will conduct a deposition of non-party The Hartford's corporate representative pursuant to Rule 30(b)(6) of the Federal Rules of Civil Procedure. Accordingly, the plaintiff's Motion to Compel is hereby DENIED without prejudice. When discussing dates for the forthcoming 30(b)(6) deposition, the parties further advised the Court that discovery is presently set to close on May 28, 2024 in the underlying Eastern District of Pennsylvania ("EDPA") case (No. 23-CV-3782 (JFM)), and that a conference regarding the defendant's related Motion for Extension of Time to Complete Discovery in that matter is set for May 17, 2024. Consequently, the Court instructs that on or before May 20, 2024, the parties shall file a Joint Status Report ("JSR") in this case, which will advise the undersigned as to: (a) their new discovery deadline in the EDPA matter; (b) a date certain by which the aforementioned 30(b)(6) deposition will be completed; and (c) a date certain upon which the parties will file yet another JSR in this matter advising as to the status of the plaintiff's dispute with non-party The Hartford following the 30(b)(6) deposition.
