| Filing 11 NOTICE OF INSUFFICIENCY. The plaintiff, Jake Ruffino, has moved for leave to proceed in forma pauperis; in other words, he has asked for permission to begin a federal civil rights lawsuit without prepaying the $405 filing fee. A federal law, 28 U.S.C. 1915, permits him to do so if (among other things) he files an affidavit showing that he is "unable to pay" the fee, along with a copy of his inmate trust account statement for the preceding six months. The law requires a six month account statement to prevent inmates who can afford the fee from faking poverty by spending their money on frivolities or sending it outside the facility just to appear impoverished at the time they file their suit.In this case, Mr. Ruffino had only $1.74 in his inmate trust account at the time he filed his lawsuit. (ECF No. 4, at 5.) But he received a $2500 deposit just a couple of months before, presumably from his settlement of his prior case, Ruffino v. Coleman, 23-cv-322. He then sent the overwhelming majority of those funds outside the facility in a series of special requests. (ECF No. 4.)Mr. Ruffino must explain these transfers if he wishes to proceed in forma pauperis in this case. He is directed to file a statement with the Clerk of the Court, explaining in detail who he sent the money to and for what purpose. The statement may be handwritten, but it must (a) include the case name of Ruffino v. Guadarrama et al., (b) include the case number of 25-cv-1021-OAW, (c) be signed under penalty of perjury, and (d) be filed by August 11, 2025. If Mr. Ruffino does not file the statement by August 11, he will have neither paid the filing fee nor proven his entitlement to in forma pauperis status; in that event, his case may be dismissed.
