"In determining whether jurisdiction is proper, [the court] look[s] only to the jurisdictional facts alleged in the Notices of Removal." In re Methyl Tertiary Butyl Ether (MTBE) Prods. Liab. Litig., 488 F.3d 112, 124 (2d. Cir. 2007). Also, "[i]n ruling on fraudulent joinder, a court . . . . may examine evidence outside of the pleadings but only if that evidence 'clarif[ies] or amplif[ies] claims actually made in the notice of removal.'" Wilmington Sav. Fund Socy, FSB v. Universitas Educ., LLC, 164 F. Supp. 3d 273, 284 (D. Conn. 2016) (quoting 16 Moore's Federal Practice, 107.14 #2 [c] (Matthew Bender 3d ed.)). Here, the affidavit of Robert McDonough (ECF No. [19-1]) establishes by clear and convincing evidence the jurisdictional facts alleged in paragraphs 23 through 25 of the Notice of Removal (ECF No. #1 ), and there is no possible basis for a negligence claim against Avangrid, Inc.
