ORDER CONSOLIDATING CASES. This case and 3:25-cv-1438 both arise from the same nucleus of operative fact in that they both allege that the search of Plaintiff's cell phone and T-Mobile cell phone records occurred without probable cause. Because they are so closely related, the Court hereby consolidates the two cases and designates 3:25-cv-1310 as the lead case. The Clerk is directed to consolidate 3:25-cv-1438 into this case and administratively close 3:25-cv-1438. All future filings must be docketed under 3:25-cv-1310. Smith shall file a consolidated complaint by January 5, 2026. The consolidated complaint must name all Defendants in the case caption and state all of Smiths allegations against the named Defendants.
