March 16, 2026 Opinion or Order Filing 38 ORDER. Under Federal Rule of Civil Procedure 15(a)(1)(B), a party may amend its pleading once as a matter of course within 21 days after service of a motion under Federal Rule of Civil Procedure 12(e) for a more definite statement. Here, Defendants filed such a motion on February 19, 2026, so Plaintiff's 21-day period to amend as of right would have expired on March 12, 2026. On March 13, 2026, Plaintiff filed an amended complaint, which identifies which claims are brought against which Defendants -- the primary flaw Defendants identified with Plaintiff's original complaint in their motion for a more definite statement. See ECF Nos. 29-1, #37 . Although the amended complaint was filed one day beyond the 21-day period, the Court will excuse Plaintiff's delay because she is a pro se litigant and amendments are to be granted freely "when justice so requires." See Fed. R. Civ. P. 15(a)(3). The Scheduling Order in this matter provides that Plaintiff's requests to amend made before March 26, 2026, will be governed by Rule 15. See ECF No. #27 at 1.Thus, the Court will consider the amended complaint to be the operative complaint in this matter. By March 27, 2026, Defendants shall file an answer or other response to the amended complaint, or a notice stating that they seek to have their earlier-filed motion for a more definite statement applied against the amended complaint. See Pettaway v. Nat'l Recovery Sol's, LLC, 955 F.3d 299, 303 (2d Cir. 2020) (allowing a district court to either deny a pending motion to dismiss as moot upon the filing of an amended complaint or evaluating the motion in light of the facts alleged in the amended complaint). Use of AI without verification of the accuracy of the information it generates like any other shoddy research method from other sources or tools implicates Federal Rule of Civil Procedure 11, the central purpose of which is to deter baseless filings in district court and thus to streamline the administration and procedure of the federal courts. Rule 11 applies fully to actions filed by pro se litigants.Therefore, all parties are on notice that the Court has a no-tolerance policy for any briefing (AI-assisted or not) that hallucinates legal propositions or otherwise severely misstates the law. Such filings will often result in sanctions absent reasonable excuse. See generally Willis v. U.S. Bank Nat'l Ass'n et al, No. 3:25-CV-516-BN, 2025 WL 1408897 (N.D. Tex. May 15, 2025).
